Website Terms of Service

These Terms of Service (hereinafter “Terms”) govern the use of the Fjuul.com website (“Service”) of Fjuul Vision Oy, a Finnish Company (2576529-6), having its registered office in Jokipuistonkaari 2 A 28, 04130 Sipoo, Finland (referred to as “Fjuul”).

Fjuul provides the Service to you under these Terms only. These Terms form a legally binding agreement between you as a user of the Service and Fjuul as the provider of the Service. Please read these Terms carefully before you start using the Service. With regards to the use of the Service, see also the Privacy Notice. Fjuul may change these Terms from time to time at its own discretion. Any changes to these Terms will be notified on the website.

By using or otherwise accessing the Service you accept and agree to follow these Terms. If you do not agree to these Terms, you may not use or otherwise access the Service.

The Service

The Service includes the use of the Fjuul.com website, the content therein and the use of contact forms in order to get in touch with Fjuul.

Fjuul may use any of its subcontractors to produce elements of the Service.

Right to use the service

Subject to your agreement and continuing compliance with these Terms and any other relevant policies, Fjuul grants you a non-exclusive, non-transferable, non-sublicensable, revocable and limited license to access and use the Service for your own non-commercial purposes.

You agree not to use the Service for any other purpose.

User conduct

You are solely responsible for all information, data, text, messages and other materials that you submit to the Service, for example when contacting Fjuul through the contact forms. You agree not to do anything on, or submit any information to, the Service that:

  • infringes any laws (for example, criminal law) or regulations or the rights of another (for example, copyright or privacy);
  • is obscene, threatening, violent, abusive, harmful to others including minors, invasive of another’s privacy, hateful, harassing, discriminatory or otherwise objectionable;
  • impersonates another or misrepresents the origin or attributes of another person;
  • is “spam” or any other form of unsolicited advertising, promotional materials, or commercial messages;
  • contains or links to computer viruses, malware or any other malicious code; or
  • disrupts or impairs the normal operation of the Service, or servers or networks connected to the Service.

External links and Content

The Service may include content and services from or links to external websites or resources (“External Content”). All External Content is the responsibility of the external provider and provided by them subject to their own terms. Fjuul has no control over and does not endorse any External Content and Fjuul is not responsible for the availability, accuracy or reliability of such External Content, or for any loss suffered by you based on reliance on the External Content.

Any dispute you have regarding External Content on the Service should be taken up with the external provider directly.

Changes to the service

Fjuul aims at maintaining a high-quality service, and at keeping the Service accessible and available for use at all times. The Service may be changed from time to time at Fjuul’s discretion. It may happen that Fjuul needs to perform maintenance or troubleshooting operations that result in the Service not being available. Fjuul shall keep the downtime as short as possible and will try to inform you in advance of such situations.

Limitation of liability

Fjuul or its subcontractors shall not be liable for of any loss, damage or liability arising out of or in connection with the Service, the Terms, or the agreement thereunder, whether in contract, tort (including negligence) or for breach of statutory duty or in any other way for:

  • any indirect or consequential loss or damage;
  • any economic loss, loss of use, revenue, profits, data, contracts or business whether direct or indirect;
  • any special or punitive damages;
  • any loss of goodwill or reputation; or
  • the loss of any anticipated savings
  • in any case, and whether or not the same were within the contemplation of the parties when entering into the agreement.

The above limitations of liability shall not apply to damages caused by wilful misconduct or gross negligence.

Insofar as mandatory provisions of law do not allow some of the above limitations, the limitations shall nevertheless be applied to the fullest extent allowed under law.

Applicable law and Dispute resolution

The Service, the Terms and the agreement thereunder are exclusively governed by laws of Finland, excluding its choice of law provisions. The mandatory provisions of the Consumer Protection Act (38/1978) shall not be deviated from.

If a dispute arises between you and Fjuul, we strongly encourage you to first contact us directly to seek a resolution by contacting us at https://www.fjuul.com/contact/.

Any claim or dispute hereunder may be resolved by the Helsinki District Court, or the District Court of your permanent domicile in Finland. As a consumer, you may also elect to ask for a decision recommendation from the Consumer Disputes Board (Kuluttajariitalautakunta, Hämeentie 3/PL 306, 00531 Helsinki).

Transfer of the agreement

Fjuul may transfer this agreement to a third party in connection of a transaction involving transfer of its assets.
